Electronic Communications & E-Sign Consent
This Electronic Communications Policy and Consent (“E-Consent”) explains how ALAMEDA HOME LOANS LLC (“Company,” “we,” “us,” or “our”) may provide disclosures, notices, agreements, and other communications to you in electronic form in connection with the website at alamedahomeloans.com, the APPNAME mobile application, and related services (collectively, the “Services”). It also describes how you may withdraw consent where permitted by law.
1. Scope and acceptance
By using the Services, submitting an application, creating an account, checking a box labeled to indicate consent where presented, or otherwise affirmatively agreeing to receive electronic records, you consent to receive certain communications electronically and to use electronic records and signatures in connection with transactions governed by the federal Electronic Signatures in Global and National Commerce Act (“E-Sign Act”) and the Uniform Electronic Transactions Act (“UETA”) as adopted in applicable states, subject to exceptions provided by law.
If you do not consent to electronic delivery as required for a particular transaction, you may be unable to complete that transaction online and may need to use paper processes where available.
2. Categories of electronic communications
Depending on your interactions with us, electronic communications may include:
- Privacy notices, Terms of Use updates, and other legal disclosures.
- Application status messages, requests for additional information, and identity verification prompts.
- Disclosures required by consumer credit laws, including Truth in Lending disclosures, adverse action notices, and similar notices required by Regulation B, Regulation Z, the Fair Credit Reporting Act, or other applicable statutes and regulations, where delivered electronically in compliance with those laws.
- Loan documents, promissory notes, payment schedules, and modification agreements presented by lenders.
- Customer service correspondence, security alerts, and account notices.
- Marketing communications where permitted and subject to your choices.
Third-party lenders and servicers may provide separate electronic disclosure programs. Their terms control the delivery of their documents.
3. Methods of delivery
We may deliver electronic communications by one or more of the following methods: (a) email to the address you provide; (b) posting on our website or within APPNAME; (c) push notifications or in-app messages; (d) SMS/MMS where you have opted in and where permitted by law; or (e) other electronic means we describe at the time of collection. You are responsible for maintaining accurate contact information and for reviewing communications delivered through the methods you select.
4. Hardware and software requirements
To access, view, and retain electronic disclosures, you should have: a device with internet access; a current web browser that supports TLS 1.2 or higher; a valid email account; sufficient storage to retain records or a printer to print copies; and, for some documents, software capable of displaying PDF files. We may update minimum requirements from time to time and will post changes as required.
5. Paper copies
You may request a paper copy of any electronic record we are legally required to provide, subject to applicable fees where permitted by law. Requests should be sent to the contact information below. We may verify your identity before fulfilling a request.
6. Updating your contact information
You must promptly update your email address, phone number, and mailing address through your account settings or by contacting us. We are not responsible for delivery failures caused by outdated contact information or filters that block our messages.
7. Withdrawing consent
You may withdraw consent to electronic disclosures for certain communications where withdrawal is permitted by law. Withdrawal may limit your ability to use online services and may require you to complete transactions by mail or in person if available. To withdraw consent, contact us using the information below. Withdrawal does not affect the legal validity of electronic disclosures provided before withdrawal takes effect.
8. Electronic signatures
When you click “I agree,” “Submit,” “Sign,” or a similar button, type your name in a signature field, or use authentication methods we provide, you intend to sign the record and agree that your electronic signature has the same legal effect as a handwritten signature to the extent permitted by law.
9. Communications in default or collections
If your account becomes past due, you may receive communications through electronic means and through other channels as permitted by law and your loan agreement, including telephone calls, text messages where consented, and postal mail.
10. Changes to this E-Consent
We may update this E-Consent periodically. Material changes will be communicated as required by law. Your continued use of electronic services after the effective date constitutes your acknowledgment of the updated E-Consent unless otherwise required.
